Coleman Team Case - "Big Boat - No Walleye"

Rule 9, Franken's Team Motion to Dismiss, Arguments ....

Coleman camp tried to have Rule 9 thrown out. Rule 9 was agreed upon before the recount by all parties involved. (see article here Coleman team - after they have already "provisionally" closed their case - has decided to argue now that Rule 9 did not work well because some of the recount judges counted duplicates rather then the originals. (Original ballots that could not be read because of damage, had duplicates made - as usual). Coleman team's claim is that some of the originals had to be counted as well. How many...? It is hard to tell, how many or if it happened at all.
The Franken team did argue that if it did happen, it happened for both sides - both sides either benefited - or lost.

Watching this argument live on theuptake.org, the Coleman team seem to flounder their case with the same "fuzziness" that they accused the recount had. The Franken team argued their rebuttal with good amount of professional organization and confidence.

Next came the argument for Franken's team motion to dismiss the case. The Franken team brought in their case a timeline of the Coleman's team actions in the court to show that their burden to show proof with their case has not been shown. They were strong in their argument.
Coleman - tried to argue their motion to dismiss "the dismiss". Their spreadsheets were not ready and their argument lacked the strength it could have had.

The judges continue to be cautious.
